Abstract

The successful state is that which works to refresh its general finance, through activating its economical status. The more the state's revenues are, the more its ability to cover the general expenses is the state is strong when the size of expenses is less than the size of general revenue, the modern state nowadays depends mainly on taxes as a major source of its resources, for covering the different canals of general expenses.

When the laws and systems of taxes are balanced between the treasure benefit and the tax payer, and between the aim and the method, the tax revenue of this state will be high, and the tax payer himself will help the state, because when the tax payer is conscious of his tax duty, and when he arranges his accounting issues, aware of the importance of the message he carries towards his state and his community, the tax yield will be plentiful.

Since the Islamic bank forms an important resource of the funding resources related to of the general treasure, being distinguished from other banks by hi different activities, that he joins between banking works and different investment works which makes it a huge resource for the tax treasure taking in consideration the huge financial revenue resulted from these activities.

In this research I will through light on the Islamic bank and its relation with the tax laws, trying to treat issues related to tax management, according to the dominant laws and restrictions of taxes.

I divided the research into five chapters, every chapter is divided into parts, every part discusses an issue of the research issues. I depended on the comparison method and on the jurisdiction issues related to Islamic banks, and on studying the legal texts, systems, and legislations dominant in both Jordan and Palestine, because I believe that the subject of banks and their relation with taxes is a legal issue, and that the Palestinian situation since tens of years is suffering from legislative problems and complications which largely reveals these issues after the Palestinian National Authority came and took economical and political responsibility in the Palestinian community. The size of defect and destruction which was caused by a group of reasons such as the Zionistic occupation and its practices and destructive polices for more than fifty years appeared, and also the size of responsibility laid upon the Palestinian National Authority and the requirements for putting polices and comprehensive reform strategies for every field of our life, through putting laws to organize the political and the managerial status according to the urgent needs, in coherence with the community needs and requirements, to bear the burden of providing the citizen's security.

The taxes law, aims at realizing the general social benefit and to confirm justice. this means that the taxes law does not aim at only punishing the people who disorder, without seeking to realize and the idea of justice, and the general benefit.

The importance of this subject flows from the economy occupies the major position in building and developing societies. Banks are vital for economy, and they are important tools of the development tools in society. If the banks succeeded in attracting internal and external fund,, in operating them, and in administrating them, the economical movement will be realized.
