Abstract :

This dissertation aimed at uncovering a fundamental instrument to deduce legal judgments, showing its reality and power, and its impact in widening the area of deduction. It demonstrates the bases of legal judgments’ deduction attributed to the wisdom of texts and the ends of deeds in such a way that helps the deductor in the act of deduction and enriches the field of deduction. It also deals with the reality of cause and interest and its relation with wisdom. It also clarifies the most important conditions of justification and what is related to the subject of this dissertation. It also deals with the reality of wisdom and its justification in the field of deduction of legal judgments including the sayings of scholars in this field and that it’s acknowledged by their public. It also deals with certain legal texts from the Holy Quran and Sunnat that denotes clearly the importance of wisdom in Islamic Legislation. It also relates some disciplines of jurisprudence that shows the dependence of various jurisprudents on wisdom in justifying a lot of legal texts. It also shows easily the way of deduction through justification by wisdom. It also shows the steps needed by the deductor to identify and control wisdom. It also reveals the relationship of wisdom by other fundamental deductive instruments like application of discretion in legal matters. It clarifies that justification by wisdom as an original instrument that has close relation with some of the deduction instruments. It also demonstrates examples for application that show the impact of justification by wisdom on Islamic jurisprudence regarding the comprehension and control of texts and collecting them in such a way that helps in their application easily
